Thieverage to Serve 20 Years

FREDERICK- Clarence Thieverage, 35, of Frederick, Maryland appeared before the Honorable Judge William R. Nicklas, Jr. and was sentenced in two separate cases to a total of 40 years in the Division of Correction, with all but 20 years suspended. Upon completion of his sentence, the defendant will be placed on 5 years of supervised probation.

On July 17, 2017, the defendant entered a guilty plea in case #10-K-17-059735 to count one, possession of fentanyl with the intent to distribute. On the same date, the defendant entered a guilty plea in case #10-K-17-059563 to count three, distribution of heroin.

On October 16, 2016, pursuant to an investigation into local drug dealers, a search warrant was executed in the area of Magnolia Tree Court in Frederick. 85.7 grams of fentanyl was seized from a clothing that the defendant had been wearing earlier in the day. On January 26, 2017, while out on $125,000 bail, the defendant was again arrested and charged with distribution of heroin as a result of 2 controlled purchases of heroin.

In asking for the sentence of 40 years will all but 20 years suspended, the State argued that a lengthy sentence was required to keep the Defendant from reoffending: “even….facing significant charges, and the threat of substantial incarceration, Mr. Thieverage continued the business of selling powerful and deadly opiates. It was only when he was held without bond when charged with the second case that his dealing stopped.” Further, the State cited statements obtained through investigation to show the defendant was a dealer and not a user. In the defendant’s own words, “up until I got knocked man I made a lot of money, and I wasn`t using, I was making mad money.”
