Cody Fowler Guilty of 2nd Degree Rape
FREDERICK – Cody Fowler, 22 of Jefferson, MD was found guilty of Second Degree Rape.
The trial began on January 23, 2018 and the jury deliberated for approximately three hours before delivering the verdict.
The offense occurred on October 28, 2016, during a small party at a private residence in Jefferson, MD. The victim had become voluntarily intoxicated and reported having no memory of events for several hours. When she awoke she was experiencing significant pain and injury to her genitalia. A sexual assault examination at Frederick Memorial Hospital confirmed those injuries were a result of penetration and trauma. Forensic tests implicated the defendant Fowler. During the investigation, however, the defendant gave a statement denying he had any contact sexual with the victim.
The Honorable Julia Martz-Fisher deferred sentencing until a pre-sentence investigation could be completed and revoked the defendant’s bond. Sentencing is scheduled for March 3, 2018 at 10:00 a.m. The maximum sentence for Second Degree Rape is 20 years and the defendant’s sentencing guidelines range between 7 to 13 years of active incarceration.
